Terms of Service
These Terms of Service ("Terms") govern your use of nopad (the "Service") — an SMS-based homeschool coaching service operated by Question Base AI Inc., a Delaware corporation ("nopad," "we," "us," or "our"). By creating an account or using the Service, you agree to these Terms.
1. The Service
nopad is a coaching service for homeschool parents. After you sign up, our AI coach (S.O.F.I.) sends you scheduled exercise materials and replies to your questions over SMS. Materials are designed to be worked on offline by your child with your guidance. We do not provide direct instruction to children, and children do not interact with the Service directly.
2. Eligibility and account
You must be at least 18 years old and the parent or legal guardian of any child whose information you submit to the Service. You are responsible for all activity that occurs under your account, including any messages you send via SMS using the phone number you provided.
You agree to provide accurate information during onboarding and to keep your account current. We may suspend or terminate accounts that provide false information or that we reasonably believe are operated by someone other than the registered parent.
nopad currently operates in single-parent mode. Each account is tied to one parent or guardian and to the phone number used at signup. Only that parent can access the account, manage a child's information, or make requests about it. We cannot add co-parents or act on requests from anyone other than the registered parent.
3. SMS messages
The Service is delivered primarily through SMS. By tapping "Send me texts" during onboarding, you consent to receive recurring SMS messages from nopad about your child's learning, including coach replies, scheduled exercise notifications, schedule-pause notifications, and upgrade prompts.
Message frequency is approximately one to four messages per day per child. Message and data rates may apply from your carrier. We do not charge for SMS itself, but your mobile carrier may.
You can opt out at any time by replying STOP to any nopad message. Reply HELP for help. Opting out unsubscribes the phone number from all nopad messages and ends the active portion of your Service; your account remains and you can re-enroll by signing in again.
4. Subscription and payment
nopad offers a free tier capped at a small number of exercises, after which continued use requires a paid subscription. Subscriptions are processed by our payment provider, Stripe. When you subscribe, you affirmatively consent to a recurring charge that automatically renews at the interval and price disclosed to you at checkout, and that continues until you cancel.
Canceling is easy — and no harder than signing up. You can cancel at any time through the Stripe billing portal, which is available at a URL we provide by SMS or email, or by emailing help@questionbase.com. We will not require you to call, wait on hold, or complete extra steps to cancel. Cancellation stops all future renewals. It takes effect at the end of the current billing period, and we do not pro-rate refunds for unused time except where required by law.
5. Acceptable use
You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable regulation
- Provide information about a child who is not your own or for whom you do not have legal guardianship
- Attempt to bypass usage limits, abuse rate limits, or interfere with the Service's operation
- Use the Service to send messages that you did not generate or that impersonate another person
- Resell, sublicense, or use the Service to provide a competing offering
- Submit content that is illegal, harmful, harassing, or that infringes the rights of others
6. Your content
You retain ownership of any text you send to S.O.F.I., observations you record about your child, and information you provide during onboarding. By using the Service, you grant us a limited license to process this content to provide and improve the Service, including running it through our AI provider (Anthropic Bedrock) and image generator (OpenAI) where required for exercise generation.
We do not sell your content, and we do not use it to serve advertising. Our AI providers process this content only to generate your materials and responses for you — they do not train their models on it and do not retain it beyond what is needed to handle the request. 7. Materials we generate
Exercises and coach responses are generated by AI. They are intended as a starting point for your own teaching and supervision. You are responsible for reviewing materials before using them with your child. We make no guarantee that any specific exercise is appropriate for any specific child, and we do not replace professional educational or developmental advice.
8. Termination
You may stop using the Service at any time by canceling your subscription and opting out of further messages. Deleting your account automatically cancels your subscription, and you will not be charged again after deletion. We may suspend or terminate your account if you violate these Terms, abuse the Service, or charge back valid payments. We will normally give notice before terminating unless the violation requires immediate action.
On termination, your data is retained for 30 days in case you want to reactivate, then permanently deleted from active systems. Backups follow the schedule described in our Privacy Policy.
9. Disclaimers
The Service is provided "as is" and "as available." We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that AI-generated content will be accurate, appropriate, or free from mistakes.
10. Limitation of liability
To the maximum extent permitted by law, in no event will Question Base AI Inc., its officers, directors, employees, or agents be liable to you for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or use, arising from your use of the Service. Our total liability for any claim arising from the Service is limited to the amount you paid us in the twelve months preceding the claim.
11. Indemnification
You agree to indemnify and hold Question Base AI Inc. harmless from any claim arising out of (a) your use of the Service, (b) content you submit, (c) your violation of these Terms, or (d) your violation of any third party right, including any intellectual property or privacy right.
12. Copyright and DMCA notices
We respect intellectual property rights and expect users to do the same. If you believe content available through the Service infringes a copyright you own or control, send a notice to help@questionbase.com (Attn: DMCA Agent) that includes:
- your physical or electronic signature;
- identification of the copyrighted work you claim has been infringed;
- identification of the material claimed to be infringing and enough detail for us to locate it;
- your contact information (address, telephone number, and email);
- a statement that you have a good-faith belief the use is not authorized by the copyright owner, its agent, or the law; and
- a statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the owner's behalf.
We respond to valid notices as required by the Digital Millennium Copyright Act, including removing infringing material and, in appropriate circumstances, terminating the accounts of repeat infringers.
13. Florida scholarship programs (Step Up For Students / PEP)
If you pay for nopad using funds from a Florida scholarship program — such as the Family Empowerment Scholarship or the Personalized Education Program (PEP) administered by Step Up For Students — additional terms apply. Scholarship-funded purchases are subject to the program's requirements, including that funds be used only for eligible educational purposes, and to a separate Florida Scholarship Program Addendum that will control in the event of any conflict with these Terms. We will make those terms available to scholarship families once nopad is an approved program vendor.
14. Changes to these Terms
We may update these Terms from time to time. The most current version is always posted on this page, with the "Effective" date at the top reflecting the latest revision. For material changes that affect your subscription or your rights, we will make reasonable efforts to notify you in advance by SMS or email. Your continued use of the Service after the effective date constitutes acceptance.
15. Governing law
These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws principles. Any dispute will be resolved in the state or federal courts located in Delaware, and you consent to the exclusive jurisdiction of those courts.
